A p\u00e9nz fizet\u00e9s\u00e9re ir\u00e1nyul\u00f3, lej\u00e1rt k\u00f6vetel\u00e9s, mint p\u00e9ld\u00e1ul a hat\u00e1rid\u0151ben vissza nem fizetett hitel, fizet\u00e9si meghagy\u00e1s \u00fatj\u00e1n is \u00e9rv\u00e9nyes\u00edthet\u0151 a hitelez\u0151 r\u00e9sz\u00e9r\u0151l, az ad\u00f3ssal szemben. Jogosulti oldalr\u00f3l \u00e9rdemes tudni, hogy a k\u00f6zjegyz\u0151i elj\u00e1r\u00e1s d\u00edjk\u00f6teles, a k\u00f6vetelt \u00f6sszeg 3%-a, de legal\u00e1bb 8.000.-Ft. Ezt a k\u00f6lts\u00e9get azonban a k\u00f6telezettre \u00e1t lehet h\u00e1r\u00edtani, ahogyan a jogosult k\u00e9pviselet\u00e9ben elj\u00e1r\u00f3 \u00fcgyv\u00e9d munkad\u00edj\u00e1t is. Amennyiben az elj\u00e1r\u00f3 k\u00f6zjegyz\u0151 a fizet\u00e9si meghagy\u00e1st kibocs\u00e1tja, akkor a k\u00f6telezettnek a r\u00e9sz\u00e9re t\u00f6rt\u00e9nt k\u00e9zbes\u00edt\u00e9st\u0151l sz\u00e1m\u00edtott 15 napja van, hogy \u00edr\u00e1sban ellentmond\u00e1st terjesszen el\u0151 a k\u00f6zjegyz\u0151n\u00e9l, ha a k\u00f6vetel\u00e9st ak\u00e1r jogalapj\u00e1ban, ak\u00e1r \u00f6sszeg\u00e9ben vitatja. Az ellentmond\u00e1ssal meg nem t\u00e1madott fizet\u00e9si meghagy\u00e1s, a nyitva \u00e1ll\u00f3 hat\u00e1rid\u0151 eltelt\u00e9vel joger\u0151s lesz \u00e9s a jogosult a k\u00f6vetel\u00e9s\u00e9t v\u00e9grehajt\u00e1si elj\u00e1r\u00e1sban is \u00e9rv\u00e9nyes\u00edtheti. Fontos azonban megeml\u00edteni, hogy a fizet\u00e9si meghagy\u00e1s \u00e1t nem v\u00e9tele egy\u00e1ltal\u00e1n nem jelenti azt, hogy a k\u00f6telezett „megmenek\u00fcl”, sokkal ink\u00e1bb elnehez\u00edti ezzel a saj\u00e1t , elj\u00e1r\u00e1sbeli helyzet\u00e9t. Amennyiben pedig a k\u00f6telezett a fizet\u00e9si meghagy\u00e1snak hat\u00e1rid\u0151ben ellentmond, az elj\u00e1r\u00e1s a k\u00f6zjegyz\u0151t\u0151l b\u00edr\u00f3s\u00e1gi \u00fatra ker\u00fcl, az elj\u00e1r\u00e1s perr\u00e9 alakul.<\/p>\n\n\n\n
